1. About Branch & Bloom:
 

Branch & Bloom is a UK horticulture marketplace and professional directory operated by an individual sole trader.

Branch & Bloom provides an online platform intended to help customers discover and contact independent horticulture professionals and businesses.

In these Terms, “Branch & Bloom”, “we”, “us” and “our” refer to the operator of Branch & Bloom.

By using the Branch & Bloom website, submitting an enquiry, requesting a quote, or applying for a professional listing, you agree to these Terms where they apply to your use of the service.

Nothing in these Terms affects statutory rights that cannot lawfully be excluded or restricted.
 

2. Our Role:
 

Branch & Bloom provides a marketplace and directory through which customers can discover horticulture professionals and businesses.

Unless expressly stated otherwise, professionals listed on Branch & Bloom are independent businesses or individuals and are not employees, agents or representatives of Branch & Bloom.

Branch & Bloom does not currently perform the horticultural services advertised by professionals on the platform.

Where a customer chooses to engage a professional, the agreement for the horticultural work is normally between the customer and the professional.
 

The professional and customer are responsible for agreeing matters such as:
 

• Work to be performed

• Price and payment

• Timescales

• Materials

• Cancellations

• Guarantees or warranties

• Any other terms relating to the work
   

Branch & Bloom is not currently a party to that service contract unless expressly stated otherwise.
 

3. Current Marketplace Status:
 

Branch & Bloom is a developing marketplace.
 

The number of professionals, geographical coverage and features available through the website may therefore be limited while the marketplace grows.

Some profiles or listings may be clearly marked “Demo”, “Demo Profile”, “Example Listing” or similar. These are examples designed to demonstrate how the marketplace works and do not represent real professionals available for hire.
 

We will not intentionally present a demonstration listing as a genuine professional listing.
 

4. Finding and Contacting Professionals:
 

Customers may use Branch & Bloom to browse professional listings, explore horticultural service categories and submit enquiries or quote requests where those facilities are available.

Submitting an enquiry or quote request does not guarantee:
 

• That a professional will respond

• That a professional will be available

• That a professional will accept the work

• A particular price

• That an agreement will be reached

• Any particular outcome from the enquiry
   

Customers should discuss the scope, price and terms of work directly with the professional before agreeing to proceed.
 

5. Professional Listings:
 

Horticulture professionals and businesses may apply to be listed on Branch & Bloom.

Submitting an application does not automatically guarantee that a listing will be created or remain published.

Professionals are responsible for ensuring information they provide is accurate, current and not misleading.

This includes information concerning their:
 

• Business name

• Services

• Qualifications and experience

• Service areas

• Contact information

• Photographs and portfolio material

• Insurance

• Licences, registrations or memberships where relevant

• Other claims appearing in their listing
   

Professionals should notify Branch & Bloom if important information in their listing changes.
 

6. Checks and Verification:
 

Branch & Bloom will only describe a professional as verified, checked, vetted, approved, accredited or similar where we have actually carried out the checks described on the website.

The presence of a professional on Branch & Bloom should not by itself be interpreted as a guarantee or endorsement of that professional unless expressly stated.

Customers should make reasonable enquiries appropriate to the work they are considering, which may include requesting evidence of qualifications, insurance, licences, references or previous work where relevant.
 

7. Responsibilities of Professionals:
 

Professionals using Branch & Bloom must comply with applicable laws and regulations relating to their business and services.

Professionals must not knowingly provide false or misleading information.

Where applicable to their work, professionals are responsible for maintaining appropriate insurance, qualifications, permissions, licences and registrations.

Professionals are responsible for the horticultural services they agree to provide to customers, including the quality, safety and legality of those services.
 

8. Customer Responsibilities:
 

Customers are responsible for providing reasonably accurate information when making an enquiry.

Customers should ensure that they understand and agree directly with a professional:
 

• What work will be carried out

• The total price or basis for calculating it

• Payment arrangements

• Expected timescales

• Cancellation or other applicable conditions

before work begins.
 

Customers must not use Branch & Bloom to send abusive, fraudulent, unlawful or deliberately misleading enquiries.
 

9. Prices and Payments:
 

Branch & Bloom does not currently process customer payments for horticultural services through the website.

Any payment for horticultural work is currently arranged directly between the customer and the relevant professional.

Branch & Bloom is not responsible for collecting, holding or transferring those payments unless expressly stated otherwise.

Professional listings are currently offered without a listing fee unless otherwise clearly agreed.

If Branch & Bloom introduces paid listings, subscriptions, booking fees, commissions, deposits or customer payment processing in the future, appropriate additional or updated terms will be provided before those services are introduced.
 

10. Disputes Between Customers and Professionals:
 

If a dispute arises concerning horticultural work arranged with an independent professional, customers and professionals should normally attempt to resolve the matter directly with each other.

Branch & Bloom may, where appropriate, accept reports or concerns relating to professionals appearing on the platform.

However, unless required by law or expressly agreed otherwise, Branch & Bloom is not responsible for deciding contractual disputes between customers and independent professionals.

We may investigate complaints relating to use of the Branch & Bloom platform and may take action regarding a listing where appropriate.
 

11. Reviews:
 

If Branch & Bloom introduces customer reviews, users must only submit genuine reviews based on genuine experiences.

Fake, fabricated, abusive or deliberately misleading reviews are not permitted. Incentivised reviews must be appropriately disclosed where required.

Branch & Bloom may moderate or remove reviews where there is a legitimate reason to do so, including suspected fraud, illegality, abuse or violation of our review rules.
 

12. Acceptable Use:
 

You must not use Branch & Bloom:
 

• For unlawful or fraudulent purposes

• To impersonate another person or business

• To submit knowingly false information

• To distribute malicious software

• To attempt unauthorised access to the website or its systems

• To harass other users or professionals

• To interfere with the operation or security of the website

• In a way that infringes another person's intellectual-property or other legal rights
   

We may restrict access or take appropriate action where the platform is being misused.
 

13. Photographs, Logos and Listing Content:
 

Professionals retain ownership of content they own and submit to Branch & Bloom.

By providing photographs, logos, descriptions or other material specifically for a Branch & Bloom listing, the professional gives Branch & Bloom permission to use, reproduce, format and display that material as reasonably necessary to operate and promote the listing and Branch & Bloom marketplace.

Professionals must have the necessary rights or permission to provide material they submit.

This permission ends when the material is no longer reasonably required for these purposes, subject to reasonable technical, archival and legal requirements.
 

14. Branch & Bloom Intellectual Property:
 

The Branch & Bloom name, branding, logo, website design, original written content and other material created by Branch & Bloom are protected by applicable intellectual-property laws.

You may use the website for its intended purpose but may not copy, reproduce, sell or commercially exploit Branch & Bloom's original material without permission, except where the law permits.
 

15. Availability of the Website:
 

We aim to keep Branch & Bloom accessible and functioning but cannot guarantee that the website will always be available or completely free from technical errors.

We may need to modify, maintain or temporarily suspend parts of the website.

Where reasonably possible, we will seek to minimise disruption.
 

16. Third-Party Websites and Services:
 

Branch & Bloom may contain links to websites, social-media pages or services operated by independent third parties.

Branch & Bloom does not control those third-party services and is not responsible for their content or practices.

Users should review the applicable terms and privacy information when using third-party services.
 

17. Our Responsibility:
 

Branch & Bloom is responsible for the services Branch & Bloom itself provides in accordance with applicable law.

Independent horticulture professionals are responsible for the services they separately agree to provide to their customers.

Branch & Bloom is not responsible for losses caused solely by the acts or omissions of an independent professional where Branch & Bloom is not legally responsible for those acts or omissions.

Nothing in these Terms excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights that cannot legally be excluded.

18. Removing or Suspending Listings
 

Branch & Bloom may remove, suspend or decline a professional listing where there is a reasonable reason to do so, including where:
 

• Information appears materially false or misleading

• A professional has seriously or repeatedly breached these Terms

• The listing may be unlawful

• There are credible safety or fraud concerns

• The professional requests removal

• Removal is reasonably necessary to protect users or the operation of Branch & Bloom
   

Where appropriate and reasonably practicable, we may contact the professional regarding the issue.
 

19. Privacy:
 

Personal information collected through Branch & Bloom is handled in accordance with our Privacy Notice.

Users should read the Privacy Notice to understand what information we collect and how it is used.
 

20. Changes to Branch & Bloom:
 

Branch & Bloom is an evolving marketplace and features may change as the service develops.

We may add, modify or discontinue features.

Where a change materially affects existing contractual rights or obligations, we will deal with the change fairly and provide appropriate information or notice where required.
 

21. Changes to These Terms:
 

We may update these Terms to reflect changes to Branch & Bloom, applicable law or the way the marketplace operates.

The latest version will be published on the website with its last-updated date.

Changes will not retrospectively remove rights that users already have under applicable law.
 

22. Governing Law:
 

These Terms are governed by the laws of England and Wales, subject to any mandatory legal rights a consumer may have under the laws applicable to them.

Nothing in these Terms is intended to prevent a consumer from using a court or other remedy available to them under applicable law.
